Companies who self-administer claims are challenged when educating and training their claims staff. This series of course casts teaches basic principles for those who adjust claims. This is a series of course casts covering specific topics of interest to claims administrators to assist them in investigating and evaluating claims exposures.
Risk Managers who have recently hired insurance or claims analysts should consider this series of course casts to accelerate the learning process and improve the ability of their internal claims staff to understand the issues they face in resolving claims.

The Law of Agency: Hidden Liabilities
This new CourseCast begins by reviewing the concept of agency law and how it is defined. Once the basics are covered, specific issues such as how tort law is applied in agency cases, liability imposed by bailments and vicarious liability will be discussed and analyzed. e will discuss the degrees of care owed to classes of people and how the defendant’s duty to the plaintiff impacts the claim evaluation. Additional concepts such as immunity from liability, assumed or contractual liability, and the master/servant rule will be discussed. Following this program, attendees will:

Be able to apply tort concepts in agency relationships

Understand how independent contractor relationships alter the agency/principal relationship

Elise M. Farnham, AIM, ARM, CPCU, CPIW
Elise M. Farnham, CPCU, is President of Illumine Consulting, a firm dedicated to providing services to insurance and risk management professionals through continuing education and claims management consulting. She has over 30 years of experience in risk management and insurance having held executive positions with Crawford & Co., GAB Robins N.A., The Harmonie Group, and Carson-Brooks.
Ms. Farnham is a member of the CPCU Society, RIMS, and NAIW. She is a member of the Board of Ethical Inquiry for the American Institutes for CPCU and serves on advisory panels for the CPCU, AIC, and ARM programs.
In 1993, she was named National Claim Professional of the Year by the National Association of Insurance Women (International) and was national president for that organization in 1998/99. She was recognized as Insurance Woman of the Year by the Insurance Professionals of Atlanta in 2003 and 2004. Ms. Farnham is a frequent speaker and her articles have appears in Business Insurance, Claims Magazine, CPCU Claim Quarterly, Today’s Insurance Professional, and Insurance International (a U.K. publication.) www.elisefarnham.com
W. Michael McDonald
W. Michael (Mike) McDonald is Vice President - Risk Management for Quality Distribution, Inc., the largest bulk transporter of chemicals in North America, with a fleet of 3,500 vehicles. He has specific responsibility for overseeing Property/Casualty, Claims, Environmental Emergency Response, and Independent Contractor Insurance programs for its worldwide operations.
In 1966, Mr. McDonald began his career serving for the first 10 years in various positions at Instrument Systems Corporation, Richardson-Merrill, Inc., Port Authority of New York and New Jersey and Liberty Mutual Insurance Company with responsibilities in insurance underwriting and corporate risk management. In 1976, he joined United Technologies Corporation/Otis Elevator Company as international/corporate risk manager. Mr. McDonald relocated to Florida in 1986 and joined Ryder System as group director, risk management, and president of their claims subsidiary, Ryder Services Corporation. In 1991, he joined Homeowners Marketing Services, Inc. as vice president, risk management. From 1994 to 1997, he served as director, risk management for Value Rent-A-Car, and in the same capacity for Walter Industries from 1997 until 2002, when he took a position as Director of Risk Management for Danka Business Systems, PLC. During 2005, he joined his current employer.
Mr. McDonald currently serves on the RIMS Board of Directors. Elected to the Board in 1999, Mr. McDonald has served as Vice President - Conferences, Vice President - Long Range Planning & Research, and Vice President-Governance. He is a member of the Finance Committee, and liaison to the Chapter & Membership Services and Professional Development Committees.
Currently a member of the RIMS Tampa Bay Chapter, Mr. McDonald has served as president for the Connecticut Valley, South Florida and Broward Chapters, and a director of the New York Chapter. Mr. McDonald has served as chair of the international cooperation committee and was the original chair of the Risk Management Roundtable. He has served on the conference and industry liaison committees. Mr. McDonald was the first chair of the Singapore Risk Management Conference and served as co-chair of the Monte Carlo Risk Management Conference. From 1994 to 1998 he served on the Florida Regional Conference Committee and was a member of the governance committee and the Goodell award committee.
Mr. McDonald has also served as a speaker/moderator at numerous national, regional and local RIMS meetings. He received his bachelor's degree from North Carolina State University and earned the Associate in Risk Management designation from the Insurance Institute of America.
